CONCURRIENDO EL CONYUGE CON UNO O MAS HERMANOS DEL AUTOR DE LA SUCESION, TENDRAN DOS TERCIOS DE LA HERENCIA, Y EL TERCIO RESTANTE SE APLICARA AL HERMANO O SE DIVIDIRA POR PARTES IGUALES ENTRE LOS HERMANOS.
